This matter below should be treated as URGENT , since it involves a LEGAL DEADLINE. Pls pass on to all council members and remember: Cal Train electrification eir is the ENTRY PATH for statewide HSR to enter the peninsula--something most peninsula/MP residents have fought to avoid. This is your chance to help prevent that. Mike Brady, esq.

Dear Mayor Carlton and City Council Members:

I am a long time resident of MP and an atty for 50 years. I have been fighting hsr for nine years (along with my colleagues Morris Brown and Martin Engel).

A DEADLINE IS QUICKLY APPROACHING. You only have until Feb. 6 to file a suit challenging the Cal Train EIR on electrification. There are many reasons why this is defective, and YOU probably filed numerous comments and objections, which were not honored by Cal Train.

If you fail to file suit, all your objections and rights disappear. If you file, you have leverage for negotiation and for protecting the RESIDENTS of MP who will be gravely affected if the problems are not cured.

NOTE: the matter is currently being actively debated by Atherton and Palo Alto. They are seriously considering suing. They have BOTH scheduled CLOSED SESSIONS next week. Get in touch with them.

If they file, and if you were to join them, I can represent to you that I can get your attorney, Stu Flashman (with whom I have worked for four years in the leading Prop 1A lawsit against hsra) to represent you for a CAPPED fee of $15-20,000, a huge bargain (split three ways with the other two entities). As a resident of MP I would not want you to miss this opportunity to protect our residents at such a bargain price. You may call me if you have any questions. I assume your city atty is on top of all this.
