Cayetano Figueroa-Fernandez, 32, accepted the plea deal in exchange for an eight-month county jail sentence and three years' probation, chief deputy district attorney Steve Wagstaffe said. Figueroa-Fernandez may be able to serve his jail time in a residential treatment facility for his drug addiction or receive a work furlough, attorneys said. "He was referred to the alternative sentencing bureau," defense attorney Jeff Hayden said. "But the more likely scenario would have him just do the time straight." Menlo Park police arrested Figueroa-Fernandez this past summer after an informant purchased drugs from him three times from April to June in the Safeway parking lot at 525 El Camino Real in Menlo Park, Wagstaffe said. Officers also found 22 grams of methamphetamine in his San Jose home, prosecutors said. Figueroa-Fernandez apparently was wearing his Safeway uniform during the illicit transactions. He is out of custody on $40,000 bail. Safeway declined to comment on the case last year, citing personnel privacy concerns.
