I support Mr. Hildegoss coming forward and airing his idea. It is very
gracious of Mr. Duncan to step aside at this time.

Subject: Park Theatre Update
Mayor Ferguson and Council Members;
This morning I had a meeting with Jim Koch and Mr. Tom Hilligoss - at
Mr. Hilligoss's request. Mr. Hilligoss advised that he met with
Councilman Boyle and Councilman Cohen prior to the City Council Meeting
this past Tuesday and discussed with them his plan to turn the Park
Theatre into a performing arts venue. As I stated in my presentation to
the City Council on Tuesday night, my main objective is to save the Park
Theatre and to see it restored. Since Mr. Hilligoss has now stepped
forward with a plan, I think the best thing for the City is to allow him
to have an opportunity to be heard. Therefore, after meeting with mayor
Fergusson this afternoon, I have decided to stand aside for the next 30
days so that Mr. Hilligoss can work with Mr. Crittenden, City Council
and City Staff to see if an agreement can be reached on his plan for the
Park Theatre. I will support Mr. Hilligoss with any request for
information he may have regarding our due diligence to date.
In the event Mr. Hilligoss is not able to get the property in contract
or come up with a viable plan for turning the Park Theatre into a
performing arts venue, we are prepared to appropriately re-engage.
