Proposed State Law up for Vote on Tuesday at State Senate | Effect on Menlo Park

Dear Mayor and council members,

I am writing to let you know about a bill up for vote by State Senator
Hill, on this Tuesday morning.

The bill, AB 2788 (Mike Gatto - Burbank) was recently gutted and amended
from one regarding safe natural gas storage into a bill that would allow
brand new wood/steel poles, whether 40 feet or 200 feet tall, right in
front of homes; with refrigerator-sized cabinets that often generate loud
noise (cooling fans).

   - The systems could also include diesel generators and more equipment on
   the ground (sidewalk or driveway area) below.
   - The bill would remove any common sense recourse regarding placement in
   residential or historic neighborhoods.
   - Unfortunately, the bill language is deceptive. It promises Small Cells
   but the size limits are not small; since they do not account for an
   existing Federal law (known as "6409") that allows the companies to ignore
   those proposed limits (to add more equipment/generators/battery

Please consider contacting Assembly member Gatto and Senator Hill (voting
this Tuesday on the bill) to let him know your (likely) concerns with this
poorly written legislation that would harm neighborhoods and require free
use of City property/assets (see bill text regarding fees/access to City

The bill is separately opposed by many cities and organizations such as
APA, CSAC, and the League.
