A recent court case, Capistrano Taxpayers Association, Inc. v. City of San Juan Capistrano, requires the first tier of a tiered system to fully cover the Water District's operating cost and any higher tiers can only cover water conservation costs.

Our proposed 2-tier rates structure is consistent with the court ruling and meets the actual cost of service in the first tier for minimum indoor door use for a typical single family household (6 ccf) and the second tier covers water conservation costs. Other things to note: the proposed first tier will fully cover the Menlo Park Municipal Water Districts SFPUC wholesale costs (as opposed to a 75% cost recovering currently), and the typical single family resident (using 14 ccfs a month) only see a 35% overall rate increase which equates to about $24.50 more per month.

Lastly, the Proposition 218 notice that was mailed to all Menlo Park Municipal Water District customers specifically states that "protests submitted by email, fax or other electronic means will not be accepted." If you are looking to submit a formal protest, please follow the procedures outlined in the mailed notice which requires among other information, a formally submitted and signed protest to the proposed rates.

I oppose the proposed water rate increases.

While I appreciate the need to recover for increased charges from the SFPUC, the increased rates by the Menlo Park Municipal Water District disproportionately fall on those of us who currently use the least water, in large part because of our conservation efforts over the past four years.

The Tier 1 rate is proposed to rise about 75% from current levels, while the rates of those in Tier 2 whose consumption exceeds 6ccf per month will rise by only 37%.

I urge you to revise your proposed rate schedule to minimize billing increases for those who conserve and shift your cost recovery focus to those who use more. The 75%-37% imbalance between Tiers 1 & 2 should be reversed.
